Loss of Use

If your vehicle was damaged in an accident, you may be entitled to monetary damages for the loss of its use for the period of time required for it repair. Depending on the severity of the damages, your vehicle may be in the body shop for days or weeks. Often times, the insurance company will provide you with a car rental while your vehicle is in the shop being repaired. However, if you are not provided with a car rental or if you decide you don’t need one, then you may be entitled to receive money for loss of use.

Often times, the amount owed for a loss of use is calculated by determining how much it would cost to rent your same vehicle for the amount of time that it takes to fix your vehicle.  For example, depending on the value of your vehicle, it may cost $175 to rent your vehicle for a week. You may be owed $350 for loss of use, since it would cost more to rent a Porsche.

For various reasons, the insurance company may not pay you the amount that you are owed.  They may limit the amount of money they will pay for loss of use, they may limit the number of days that they will pay for your car rental, they may claim that your body shop is taking an unreasonable amount of time to fix your vehicle or they may dispute the value of your vehicle.  At The Collision Law Center, we will fight the insurance company to recover the full amount of money owed to you for the loss of use of your vehicle.
